We have designed the apps to notify you of every part of the process when searching and booking an appointment for the providers you may want or need. So when you “Register” you will want to enable notification and location services so you can get the best user experience. If you “Refuse” that is your privilege, however, we cannot guarantee your user experience if you choose not to share with Hire A Pro your needed location, and enable notifications.
These TOS shall be governed by the state of California and this TOS shall be a binding agreement between Hire A Pro Construction Corp, also stated herein as (HAP), or (Hire A Pro) and collectively (The Company, Us, We & The Site) as this agreement shall supersede all other agreements and or laws with respect to our terms of operations and use of our site individually and respectively collectively except where these terms may not be legal in any state jurisdiction, and additionally, if any part of this TOS agreement shall be found to be illegal or otherwise invalid for any respective part or portion, you agree that all other terms shall be binding as set forth herein for the enjoyment and use of your user and provider experience. SUSPENSION AND OR TERMINATION OF SERVICES & DISPUTES
When you accept the TOS, You agree to be diligent, and punctual on payment for services. So once a transaction is completed you agree that payment upon completion is due immediately. Inspection of the work performed or service performed or provided is strictly Your Obligation to agree or disagree with on the grounds of accepting the services. If for any reason you are dissatisfied you Must Discuss This With Your Service Provider First AND Immediately notify Hire A Pro. If your service provider will not offer you any other recourse, then you must file a dispute by calling Hire A Pro at 1-805-200-5304 OR Email us at email@example.com within 24 hours of the incident & Put in the Subject Line: DISPUTE (AND ENTER THE JOB NUMBER HP:XXXXXXX) –Whatever the job number of your project ID is. If you do not file a dispute and then your service provider files a dispute first, then your account will be assessed and the work will be inspected using any photos of verification or other means necessary and then a judgement of the process will be emailed to both parties for further legal action on your own terms and expense. You As The Customer & User Agree To Allow Hire A Pro Access To Your Project In The Event You File For A Dispute At A Time Convenient To You For An Inspection Of Workmanship and Material Interpretation By Any of Hire A Pro’s Staff, Contractors, Attorneys, Adjusters, or Agents. If You Refuse You Forfeit Your Rights To Any Refund or Remuneration For Any Reason Whatsoever. Either User or Providers - If you are deemed to be the irresponsible party, your account may be terminated or suspended depending upon the circumstances. So always make sure to be diligent in Verifying Your Provider, & Inspecting Your Providers Work and or Service or Products that you buy through Hire A Pro! Additionally, Your Payment Shall Constitute Acceptance of The Service, or Product or Both and shall consequently be deemed complete and no further needs shall be granted thereafter to either you or your provider. Except, If For Any Reason The Service Shall Fail due to a problem with workmanship, Hire A Pro has a 90 Day Guarantee On All Workmanship By Our Providers! Contact Us Immediately IF it is because the provider did not perform the work correctly! If there is any other reason, we still may be able to help you depending on the circumstances – so contact us regardless. Do Not Hire A Pro Outside Of The Platform! Do Not Allow Any Service Provider To Deal With You Person To Person Without The Platform. The Reason Is That You Will Not Be Allowed To Use Our Platform Again When Or If We Catch You Doing This. Your Account Will Be Suspended.

This is a perpetual agreement for each and every time you log in to your account. You As A Provider Are Allowed To Create A Registration On Hire A Pro. Your Business Will Then Be Reviewed, You Will Be Called or Emailed and Some Standard Search & Verifications Will Be Performed With You About Your Company and Your Services.
Hire A Pro Has An Obligation To Notify You That You Alone Are Responsible For Any Losses, Damages, Or Otherwise Issues That You May Incur When Working With The Public. You As The Provider Must Provide Honest & True Information About Who You Are, What Services You Are Providing, & What Area You Are Willing To Work In and Including What Hours You Will Be Available For Work. Your Customers Will Be Wanting To Know That You Are Background Checked. Do You Have To Be Background Checked? No. You Do Not. You Will Want To Be Insured and Carry General Liability Insurance In The Amount of Not Less Than 1 Million General Liability & Also Carry Workmans Compensation As Well. Is It Mandatory? No. Depending On The Service You Provide, You Must Know Regardless of Carrying Insurance You Will Still Be Responsible To Your Customers No Matter What. So Hire A Pro Has A Badge System Which Allows Your Potential Customers To See Whether Or Not You Are Insured or Have Performed A Satisfactory Background Check, Or Have Reviews. All of your clients are what you can call a “Private Client” and you are not allowed to disclose any information to anyone, including “ANYONE” WITHOUT WRITTEN CONSENT FROM THAT CLIENT & HIRE A PRO – NO EXCEPTIONS.
You agree not to take Hire A Pro’s Proprietary Site Structure or Business Model and reproduce Your Own Competing Company, or Aid Any Other Company In Data Mining Our Providers or Users. That would be counter-productive to our relationship! Additionally, You May Be Given Special Pricing Plans With Dealer/Provider Discounts Due To The Amount of Volume You Produce On Hire A Pro – That IS STRICTLY CONFIDENTIAL. So Never, Disclose That Either.
PROVIDER WARRANTY AND DISCLAIMERS
YOU – As A Provider Agree When You Register That You Are Bound To Be 100% Honest With All Parties Involved Within Your Business, Including Hire A Pro. You Represent That You Agree To Keep All Client Info Confidential, And Additionally You Agree To Warranty Your Work or Material You Are Providing To The Extent of The Manufacturer’s Warranty Up To NINETY DAYS (90 DAYS). You Agree That You Will Hold Hire A Pro Construction Corp, The Owner of This Site & Related Apps, Harmless of Any Consequences of Your Actions, Workmanship, Service, Or Lack of Proper Etiquette & Manor. Some Providers Will Be Required To Have Insurance Regardless of The TOS And Hire A Pro Reserves All Rights To Deny Service To Anyone For Any Reason Whatsoever.
BRANDING & ADVERTISING
Hire A Pro Provides Vehicle Branding For Each Of Its Approved & Insured Providers For Your Vehicle Window In Which To Identify You As A Hire A Pro Service Provider. You Will Also Be Given An Approved Hire A Pro Digital Sticker In Which You Can Post On Your Site At No Additional Cost. Hire A Pro Advertises Regularly On A Local Level To Drive Your Customers To You. When You Are Chosen To Respond To A Service Request, You Are Being Picked Exclusively And Not As A Broad Reaching Request To Multiple Providers. So Be Courteous And Quick To Respond To Every Service Request. Any Advertising You Do On Your Own Shall Be Specifically For You. As Of Now, Hire A Pro Does Not Have Any Co-Op Advertising Programs Yet. Depending On Your Radius That You Are Willing To Work, You May Also Expand Your Abilities To Get More and More Work Requests. If You Do Not Have A Website, Hire A Pro May Develop One For You At An Extreme Discount Provided You Advertise Hire A Pro On Your Site. Call or Email For More Details!

Hire A Pro is a freelance open platform for any service related business. Providers must operate under state law guidelines as proposed for their service business. The providing terms of service shall allow for all service businesses to operate in a free-market open freelance platform where you can utilize the OnDemand services that Hire A Pro offers to users wanting a quick and seamless process which confronts a secure process. Hire A Pro Does Not Monitor Your Business Use & Refuses To Micro-Manage Any Service Business Transactions Except When Notified of A Dispute.
Payments & Procedures For Getting Paid
Providers can utilize the open-market platform to distribute their services on the go. HAP provides Providers with a unique payment gateway API which connects the Providers Primary bank to your specific type of service. Our site allow you as a provider to track each transaction and track your payment systems as well including your service providers you have established for each service you provide with a unique service provider code. All transactions are provided as per the payment gateway service provider SLS (service level agreement) TOS and you as a User and Provide accept these terms for each transaction upon registration of your company.
LIMITS OF LIABILITY
You as a provider are 100% completely responsible to the “customer” and for providing all services herein and as part of this agreement, you hereby accept these TOS as a binding and mutual agreement and agree to hold The Company and provider of this platform free of any call backs, law suits, or incidents including but not limited to any fees, costs, attorney fees and or court costs, or any law suits that may arise out of your use of this freelance open-market platform in any way to the extent of your company value or personal assets depending on your level of insurance provided and whether or not you are incorporated or a sole proprietor. The Company does not and will not monitor or micromanage any part of your business or service with regards to any service level agreements otherwise known as SLA’s you may have with any user/customer with exception to the functionality of this site and its features. All features of this site may be used without limitation with exception to any illegal activity as outlined by the state of California or your state in which you operate. Further if you are a provider of service on HAP you agree to carry professional and or general liability insurance which will safeguard YOU and The Company should any issues arise in which HAP may have to be defended in any case in which you as a service provider may have become a party to a suit or a dispute arising out of any part of your service to the customer. As a provider you will name Hire A Pro Construction Corp As An Additional Insured On Your General Liability. Workman Compensation Insurance Should Be Provided as well to let your customers know you are covered. Regardless of your Insurance coverage or workman compensation insurance, you agree to hold any customer harmless of any accidents or incidents and agree to be bound to insure each client for any losses which you or your company, employees, or assigns or contractors you may employ. You agree to safeguard each client to the maximum extent regardless of your status or insurance limits.
As a customer/user of HAP you agree to be bound by these TOS and agree that this agreement shall supersede all other rights and agreements afforded to you by any other state or federal entity as a “private contractual agreement binding upon all parties and assigns.”
USERS & CUSTOMER BASE
End users can frequent the site and apps functionality simply by downloading the apps onto their smartphones. Additionally apps are not necessary as secure web functionality provides an online platform as well. Hire A Pro does not provide a store front at this time in the traditional sense for each Provider as we have developed the OnDemand Services in a broad reaching “Category and Sub-Category”- However, Providers of their service will utilize a service related functionality listed on our site to provide their services from the simplest of services to the more complex services as may be described in the categories.
Visiting any of our sites, including https://hireaproondemand.com or sending emails to Hire A Pro constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing, including but not limited to notifications, and app functionality including chats and app acceptance when downloading from the very beginning.
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, devices including phones and other devices, and you agree to accept responsibility for all activities that occur under your account or password. Hire A Pro does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. USE AND CANCELLATION POLICY Hire A Pro Policy – Your use of our apps and site as a user are free to browse and select your user. You agree to pay for all services upon completion as stipulated herein. If for any reason you are dissatisfied, then you have the sole right to demand remuneration from your provider and additionally you may get help from HAP to resolve any dispute within 72 hours of your transaction. However you agree that upon completion as a user you will inspect and approve any and all work associated with the providers’ services and further agree that payment shall constitute acceptance of the service provided in full. You must accept that you may not be allowed a full refund for the entire service as you must also agree that any part or portion of the service that was performed satisfactory as may be deemed and collectively reviewed by The Company, HAP; and the provider, a flat fee of $40 or 15% will not be refunded as this shall be setoff for electronic service provisions which go to operating the platform and all of its material matters as outlined in any manor set forth by HAP. In other words, HAP provides this platform for your use but at a cost to operate and those costs cannot be undone after the use of these apps and or sites have been utilized. Hire A Pro Is A Private Domain & Is A Consumer Advocacy As Well. We Will Fight For Your Rights As A Consumer According To These TOS.

The Service is controlled, operated and administered by Hire A Pro from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Hire A Pro Content accessed through https://hireaproondemand.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.
You agree to indemnify, defend and hold harmless Hire A Pro, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Hire A Pro reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Hire A Pro in asserting any available defenses.
In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.
Class Action Waiver
Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Hire A Pro agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. HIRE A PRO CONSTRUCTION CORP AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.
HIRE A PRO CONSTRUCTION CORP AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. Hire A Pro reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of California and you hereby consent to the exclusive jurisdiction and venue of courts in California in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Hire A Pro as a result of this agreement or use of the Site. Hire A Pro's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Hire A Pro's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Hire A Pro with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Hire A Pro with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Hire A Pro with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
Changes to Terms
Hire A Pro reserves the right, in its sole discretion, to change the Terms under which https://email@example.com is offered. The most current version of the Terms will supersede all previous versions. Hire A Pro encourages you to periodically review the Terms to stay informed of our updates.
BACKGROUND CHECK DISCLOSURE
In the interest of maintaining the safety and security of our customers Hire A Pro Construction Corp (the “Company”) will order a “consumer report” (a background report) or “investigative consumer report" on you in connection with your application as an Independent Service provider , and if you are accepted as an Independent Service provider Hire A Pro Construction Corp may order additional background reports on you for contractor purposes.
The background report may contain information concerning your character, general reputation, personal characteristics, mode of living, and credit standing. The types of information that may be ordered include but are not limited to: Social Security number verification; criminal, public, educational and, as appropriate, driving records checks; verification of prior employment; reference, licensing and certification checks; credit reports; drug testing results; and, if applicable, worker’s compensation injuries. Workers’ compensation information will only be requested in compliance with federal Americans with Disabilities Act and/or any other applicable federal, state or local laws and only after a conditional job offer is made. Credit history will only be requested when permitted by law and where such information is substantially related to the duties and responsibilities of the position for which you are applying. The information may be obtained from private and public record sources, including personal interviews with your associates, friends, and neighbors. (An “investigative consumer report” is a background report that includes information from such personal interviews, except in California where that term means any background report that is not a credit report.) The nature and scope of the most common form of investigative consumer report is an investigation into your education and/or employment history conducted by ADP Screening and Selection Services or another outside organization.
I have carefully read and understand the Background Check Disclosure and by my electronic signature authorize Hire A Pro Construction Corp to obtain a background check about me from a CRA in connection with my proposal to enter an I/C Relationship.
As allowed by law, I understand and agree that Hire A Pro Construction Corp may obtain additional background checks without a new authorization from me during my I/C Relationship with Hire A Pro Construction Corp
